TERMS OF SERVICE & ACCEPTABLE USE POLICY

This legally binding contract (the "Agreement") is by and between WEBSTAR TECHNOLOGY™ LLP, and you and your assigns, employees, agents or contractors ("You", "Your", the "Client") and is effective as of the date you purchase any products or services from WEBSTAR TECHNOLOGY™ LLP. This Agreement sets forth the terms and conditions of your use of WEBSTAR TECHNOLOGY™ LLP’s services and represents the entire agreement between You and WEBSTAR TECHNOLOGY™ LLP relating to the Services/Products/Program. This Agreement contains provisions that set forth WEBSTAR TECHNOLOGY™ LLP's Acceptable Use Policy and guarantees of a certain products and services.

By purchasing the Services/Products or Signing up for any Program from WEBSTAR TECHNOLOGY™ LLP or its other ventures, such as Magic Web India / MagicSMS.in or Others, You acknowledge and agree that You have read, understand, acknowledge and agree to be bound by all the terms and conditions of this Agreement, along with any new, different or additional terms, conditions or policies that WEBSTAR TECHNOLOGY™ LLP may establish and post on its website from time to time.

Recent detection of misuse of our services has compelled us to take action against the violating clients and also lay down a few terms and conditions. We own the sole rights to discontinue the services or deny access to anyone who fails to comply with the rules implemented by us, without any warning or prior notice. The payments received from the violating parties in such cases are also non-refundable.


WEBSITE HOSTING AGREEMENT (SHARED HOSTING)

  • 1) Misuse of the allotted server space, bandwidth etc. By the client will lead to reduction in the space and facility given.
  • 2) Distribution of free email IDs or Web space to any person other than the ones related to the website owner or the company automatically gives WEBSTAR TECHNOLOGY™ LLP the rights to decrease the number of email IDs provided.
  • 3) In case of misuse of allotted email ID space, we will have the rights to diminish the space provided for one email ID.
  • 4) All disputes are subject to Agartala, Tripura jurisdiction only.
  • 5) Misuse of bandwidth will lead a client to be entitled for lesser bandwidth in future or account would be suspended.
  • 6) Any illegal activity detected on a website will lead to sealing of the same by us with immediate effect, as per the IT rules laid out by the Indian and International IT Act.
  • 7) Intentionally tampering (Hacking or sending virus) of our server by a client will see the account suspended.
  • 8) Customers are advised to maintain data backups on their home computers or CDs to ensure that they have ready access to their data in case we have a hardware failure. However, such cases are rare in occurrence, but cannot be avoided sometimes. This is why we recommend all our clients to take regular backups for all their important e-mails, files and data by forwarding mails to other domain email IDs or by using Outlook.
  • 9) For safety reasons, we urge our customers not to divulge the password of their e-mail/hosting/ftp accounts to anyone. In cases where passwords and usernames are to be given to our employees, we suggest to change the password immediately. In every 15 days you have to change your all password for security reason.
  • 10) Customers should also maintain their payment confirmation details that have been paid to us for activation of the orders. It is also advisable to maintain the backup of our first mail which is sent to you after activation of your order and contains your User ID and password. By using the details provided, we will be able to provide you Technical/Billing support and activation/renew/control panel/reset password facility etc.
  • 11) unfortunately if website/server etc will down then we are not responsible for any losses face by client.
  • 12) For plan details and services provided by WEBSTAR TECHNOLOGY™ LLP, please refer to the particular website as the most valid reference. Any commitment made by our employees over chat/phone/mail or by any other mode, which is not mentioned in our website, will not be abided.

  • Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme)
  • Sale of any controlled substance without prior proof of appropriate permit(s)
  • Prime Banks Programs
  • Lottery Sites
  • MUDs/RPGs/PPBGs
  • Hateful/Racist/Harassment oriented sites
  • Hacker focused sites/archives/programs
  • Sites promoting illegal activities
  • Forums and/or websites that distribute or link to warez/pirated/illegal content

  • Mailer Pro/Commercial News Latter/Mailing Scripts or Program/Mass Mailing

Any of our clients should not run above mentioned Sites on our Server. If any they violate our terms, will cause Immediate Suspension.

We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene, threatening, illegal, or violates our terms of service in any manner may be removed from our servers (or otherwise disabled), with or without notice. Failure to respond to email from our abuse department within 24 hours may result in the suspension or termination of your services. All abuse issues must be dealt with via ticket/email and will have a response within 48 hours. If in doubt regarding the acceptability of your site or service, please contact us at abuse[at]magicwebindia[dot]com and we will be happy to assist you. Potential harm to minors is strictly forbidden, including but not limited to child pornography or content perceived to be child pornography (Lolita): Any site found to host child pornography or linking to child pornography will be suspended immediately without notice.

Acceptable Mail Policy

There is a maximum 200 including cc and bcc (might be changed without any prior notice) outgoing email hourly limit per domain, this limit is also applied towards mailman. If you send over this amount in any hour, most of the e-mails will bounce back with an undeliverable error. Many of our servers have a limit of 60 POP3/IMAP checks per hour per e-mail address. If you go over this you are likely to get a wrong password error message or an error stating "login incorrect". If this occurs, please wait an hour and it will automatically unblock you. To prevent this from happening again, please make sure to disable auto checking or at least set it to something higher such as once every 10 minutes.

Any mailing list larger than 1000 addresses will require a dedicated hosting solution from us. Bulk/mass email, Commercial News Latter etc are not allowed on Shared/Reseller Hosting. You can contact us for Bulk Email Marketing.

Any time you are sending a message no matter how large your e-mail list is you must throttle it. We recommend you throttle it to at the very least sending 1 email every 20 seconds. (Sending 1 every 20 seconds would send 180 emails within 1 hour, keeping you below the 200 outgoing email limits.) If the mailing list software you are using does not allow you to throttle you must switch to an application or script that will. We recommend PHPList, which can be found in your Control Panel.

IMPORTANT: If you do not throttle and you try sending 200 emails, the server will try sending all 200 in 1 second which is not possible on our shared servers. This will cause a very high load on the server and the entire server will be sluggish, potentially affecting your sites and service, until this sending process is completed. It is our job to keep the server up and running without being sluggish or experiencing issues. Anyone who causes the servers load to go high will be suspended and the process will be terminated. If you choose not to throttle, you will most likely be suspended/terminated for crashing the server.

The list must be a Double Opt-In list. This means a user has subscribed for a newsletter or other email marketing messages by explicitly requesting it and confirming the email address to be their own. Confirmation is usually done by responding to a notification/confirmation email sent to the email address the end user specified. The double opt-in method eliminates the chance of abuse where somebody submits someone else email address without their knowledge and against their will. You will not be permitted to mail any mailing list that you were given or purchased. In doing so, this will also be considered spamming and may result in termination of the offending account.

Any unsolicited e-mail being sent will result in suspension or termination of the offending account without any information. We take a zero tolerance stance against sending of unsolicited e-mail and other forms of SPAM Any mailing list MUST comply with all guidelines set forth by the United States government. These can be found at: http://www.ftc.gov/bcp/edu/pubs/business/ecommerce/bus61.shtm No direct SMTP mailers are allowed. An example of this would be a Dark mailer or The Bat!. Any mail should be sent through the local mail server/MTA for further delivery by the server and not done directly by scripts.

Payment Policy

Establishment of service is reliant upon receipt by the WEBSTAR TECHNOLOGY™ LLP of payment of affirmed charges. Following payments are due on the anniversary date of the month for that month’s service. Accounts that reach 72 hours past due will be suspended. If once account is suspended, it will be un-suspended only after receiving payment in our bank account. We are not liable for any failed transaction done by the client/bank/payment gateway.

Late Payment and Non-Payment:

72 hours past your due date, your account will be disabled (May be a Rs.200/ $4 for Hosting/Reseller Packages Reactivation fee will apply). 96 hours past your suspension, your services/server will be taken offline and "ALL FILES WILL BE DELETED FROM OUR SYSTEM".

Cancellation Policy:

Requests for cancelling accounts may be made in writing or through the helpdesk system. WEBSTAR TECHNOLOGY™ LLP preferred method of cancellation is via the helpdesk of your WEBSTAR TECHNOLOGY™ LLP hosting account. Please log into the helpdesk and you can request to have your account cancelled.

Please note -

All account cancellations must be received in the above manner at least fifteen (15) days in advance of the date of renewal. Accounts cancelled with less than fifteen (15) days notice shall be cancelled at the end of the next term and shall be charged accordingly.

Refund Policy:

Money back guarantee on all our web hosting plans, packages:

To prove to you how confident we are in our services, we will offer you a 30 day money back guarantee on web hosting plans and packages. Domain name registrations, Domain Name Transfer are non-refundable. If for any reason you are not completely satisfied with our services and cancel your account within the initial 30 days from the initial order date of your account we will refund you all your money (excluding any setup fees). Refunds may take up to two weeks to process.

Please note -

Refund will be not issue to those Customers who purchase hosting and want refund after few days without any Proper reasons (Without Waiting for Any Solution) or just for they have found any other Cheap Offer. There must have some Technical Fault which is Recorded by our Help Desk System which cannot be solved or Not have any alternatives. If this will happen WEBSTAR TECHNOLOGY™ LLP has full right make your order as a Fraud and terminate your account.

WEBSTAR TECHNOLOGY™ LLP will not issue refunds to users who have violated our Terms and Conditions or those who have their account terminated/suspended by WEBSTAR TECHNOLOGY™ LLP, for break of our terms of service. Refunds will not be made to users who exceed their allocated bandwidth limit. Accounts that are renewed for additional terms are also not subject to our money back guarantees.

If there is any FREE Domain offer or any Software or services offered with the package, then the client should pay the cost of that additional stuff to get full refund. The customer can place refund request only once.

  • Refund Will be Initiated within 60 Days from the date when Refund Request initiated. Customer may get the Refund within 15 Days when Refund has been initiated.
  • No Refund for Domain Names.
  • In Any Case, If Refund is Initiated after the 1 Month Money Back Guarantee, The Refund amount will be calculated as Prorata Basis and rest of the money will be refunded to the client. In such cases, No full refund will be initiated.

Spam:

Unsolicited commercial newsletter/advertisements (spam) are not allowed in e-mail IDs and may result in cancellation/suspension/termination of the account without any prior notice.

Resource Usage:

User may not:

  • a) Use 25% or more of system resources for longer than 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
  • b) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
  • Lottery Sites
  • c) Run any type of web spider or indexer (including Google Cash / Ad Spy) on shared servers.
  • d) Run any software that interfaces with an IRC (Internet Relay Chat) network.
  • e) Run any bit torrent application, tracker, or client. You may link to legal torrents off-site, but may not host or store them on our shared servers.
  • f) Participate in any file-sharing/peer-to-peer activities

  • g) Run any gaming servers such as counter-strike, half-life, battlefield1942, etc

Abuse of Traffic:

If any customer violates the company’s policies in site transfer or misuse of bandwidth, WEBSTAR TECHNOLOGY™ LLP can decrease its allotted Traffic quota or suspended/terminated his account without any prior notice.

Abuse of Space:

As per our policies, at least 90% of your web pages (HTML) must be “Linked” with files (.GIF, .JPEG, etc.) which is stored in our server. Web space must not be used by your visitor for Free/Paid upload, download heavy size file. Web sites containing a large number of unlinked files or using server space for data storing propose are subject to deletion of files otherwise we will cancellation the account without prior notice.

Large File Policy:

WEBSTAR TECHNOLOGY™ LLP is not for file hosting and distribution - as such, customers may not host any files larger than 40MB in size that are observed to be available for the sole purpose of download. It has been noticed that people who make use of WEBSTAR TECHNOLOGY™ LLP are able to gain to unlimited disk space and bandwidth. But this is subject to the appropriate usage of the package offered. However, WEBSTAR TECHNOLOGY™ LLP has certain constraints related to the type of material that may be added to the website. The server does not allow you to upload unnecessary software, audio or video files and large sized files If you are unsure whether your file is against this policy, please e-mail abuse[at]magicwebindia[dot]com.

Transfer:

Our transfers team will make every effort to help you move your site to us. However, transfers are provided as a courtesy service, and we cannot make guarantees regarding the availability, possibility, or time required to complete an account transfer. Each hosting company is configured differently, and some hosting platforms save data in an incompatible or proprietary format, which may make it extremely difficult if not impossible to migrate some or all account data. We will try our best, but in some cases we may be unable to assist you in a transfer of data from an old host.

The free transfer services are available for 30 days from your sign up date. Transfers outside of the 30 day free period will incur a charge; please contact a member of the transfers department with specific details to receive a price quote.

99.99% uptime guarantee:

If for any reason (except for scheduled downtimes) our network or servers are down for longer than 0.5% in any month, you can request a 10% discount for your following months services. For clients paying yearly, the equivalent to 10% of a monthly payment will be deducted off the next payment. Approval of the credit is at the discretion of WEBSTAR TECHNOLOGY™ LLP dependent upon justification provided. Third party monitoring service reports may not be used for justification due to a variety of factors including the monitor’s network capacity/transit availability. The uptime of the server is defined as the reported uptime from the operating system and the Apache Web Server which may differ from the uptime reported by other individual services. To request a credit, please contact sales[at]magicwebindia[dot]com with justification. All requests must be made in writing via email. Uptime guarantees only apply to share / reseller solutions.

Backup:

Any shared account using more than 1GB of disk space will be removed from our off site weekly backup with the exception of Databases continuing to be backed up. All data will continue to be mirrored to a secondary drive which helps protect against data loss in the event of a drive failure.

  • Legally we are not liable to provide backups to our Clients.

Network security:

In case of any tampering done to our network security, We will take an immediate action against the respective hosting account.

Liability

Client acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of WEBSTAR TECHNOLOGY™ LLP and that damages resulting from any interruption of service are difficult to ascertain. Therefore, Client agrees that the WEBSTAR TECHNOLOGY™ LLP shall not be liable for any damages arising from such causes beyond the direct and exclusive control of WEBSTAR TECHNOLOGY™ LLP. Client further acknowledges that WEBSTAR TECHNOLOGY™ LLP's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by Client for services during the period damages occurred. In no event shall WEBSTAR TECHNOLOGY™ LLP be liable for any special or consequential damages, loss or injury. In Such Cases, Refund will be Processed as Prorata Basis.

Support

WEBSTAR TECHNOLOGY™ LLP Provide 24x7x 365 Supports through our Help Desk System. If case Our Live Operator is Offline you have to create a Support Ticket from our Help Desk Area.

WEBSTAR TECHNOLOGY™ LLP does not offer tech support for application specific issues such as CGI programming, PHP or html or any other such issue unless the Programming/Development Service Provided by WEBSTAR TECHNOLOGY™ LLP. [For Resellers/Partners: - WEBSTAR TECHNOLOGY™ LLP does not provide technical support for YOUR Customers Directly. We Only Provide Support to You If Your customer get any problem they should ask you for everything and if you can’t solve their problems then you have to come to us regarding the problem and we solve it!! ] WEBSTAR TECHNOLOGY™ LLP will not make any changes in server securities (globally settings) as per clients and resellers request and will not provide any kind of support for third party software’s, scripts & applications (you can avail support only, if we develop the software for you).

BULK SMS AGREEMENT

TERMS OF USE

This is a legally valid agreement that lays out the terms and conditions for the use of all services which comes under magicSMS.in Service agreed by you. The usage of the service is limited under all the terms & conditions herewith published. This agreement shall be governed by the rules and regulations of the authorities of the government of India. Please read this agreement carefully. All notices under this agreement will be considered as written and have been duly signed once the same is electronically confirmed.

SERVICE USAGE POLICY

You agree to abide by all applicable local, national and international laws and regulations. You are solely responsible for all acts or omissions that occur under your account, including the content of the messages transmitted through the service. The SMS service that sends/receives messages to/from mobile phones is maintained by TEAM magicSMS.in. The utilization of the SMS service is subject to the following Terms of Service.

  • 1. Any illegal use of the SMS service is strictly prohibited.
  • 2. Messages containing sexual, racist or discriminatory content or any such usage of them may be considered as harassment and you are to be held responsible for this. TEAM magicSMS.in does not assume any liability for the content of messages sent.
  • 3. TEAM magicSMS.in will be exempt from any claim that may arise from third parties as a result of message content.
  • 4. You guarantee that the content of any SMS always respects and does not in any way conflict with fundamental human rights or will follow the norms of Intellectual Property Right laws. (E.g. right to privacy, prohibition of discrimination on any ground such as sex, race, colour, language, religion, political or other opinion, national or social origin).
  • 5. You accept that the service is provided for professional use only and you agree not to use it to:

  • Promote alcohol, music, dancing, dating, gambling or deception.
  • Send unsolicited messages (i.e. mobile spam) and to therefore ensure that your messages are only sent to individuals that have given you their permission.
  • Harvest, or otherwise collect information about others, without their consent.
  • Mislead others as to the identity of the sender of your messages, by creating a false identity, impersonating the identity of someone/something else or by providing contact details that do not belong to you.
  • Transmit, associate or publish any unlawful, racist, harassing, libellous, abusive, threatening, demeaning, lewd, immoral, harmful, vulgar, obscene or otherwise objectionable material of any kind. As a general guideline, if your content is not suitable for ages 13+, it most likely goes against our Usage Policy.
  • Transmit any material that may infringe upon the intellectual property rights of third parties including trademarks, copyrights or other rights of publicity.
  • Transmit any material that contains viruses, Trojan horses, worm, time bombs, cancel-bots or any other harmful/deleterious programs.
  • TInterfere with, or disrupt, networks connected to the service or violate the regulations, policies or procedures of such networks.
  • Attempt to gain unauthorized access to the service, other accounts, computer systems or networks connected to the service, through password mining or any other means.
  • Interfere with others use and enjoyment of the service.
  • Engage in any other activity that Team magicSMS.in believes could subject it to criminal liability or civil penalty/judgment.

  • 6. You acknowledge that TEAM magicSMS.in delivers SMS messages via major telecom operators and can therefore only influence the delivery transmission of SMS messages within the technical constraints imposed. SMS messages submitted via Internet will be transferred to mobile network providers, provided that the recipient's phone is switched on and doesn't have a full memory and is located in an area covered by its subscribed mobile network provider. You acknowledge that, depending on the recipient's mobile provider service, it may not be possible to transmit the SMS message to the recipient successfully.
  • 7. You are responsible for the privacy and storage of the user-name and password. You agree that all activities made through your account are legally bonded to you.
  • 8. TEAM magicSMS.in neither claims nor guarantees the availability or performance of this service and accepts no liability for transmission delays or message failures. While TEAM magicSMS.in makes every effort to deliver messages promptly.
  • 9. TEAM magicSMS.in doesn't refund the credits for undeliverable SMS messages to you because we cannot guarantee delivery of the SMS messages to recipients due to possible errors. TEAM magicSMS.in debits transmitted SMS messages according to its transmission logs. These logs are deemed correct and valid even if the customer has objected to the correctness of the accounting records, except if investigation by TEAM magicSMS.in has produced evidence of a technical problem or error.
  • 10. TEAM magicSMS.in reserves the right to exclude you from using this service, refunding you any remaining amount in your account. All purchases must be considered as final, in compliance with our no refund policy.
  • 11. The SMS account balance is non-refundable and does not bear interest. All the SMS must be used in the validity period from the date of the purchase and no carry forward of the credits will be made unless otherwise defined in a separate contract.
  • 12. You under take the whole responsibilities regarding the messages sending through magicSMS.in services from your account, which are transmitted as per your request.
  • 13. You shall indemnify and reimburse TEAM magicSMS.in all liabilities, costs, losses and damages, in case of any claim brought against TEAM magicSMS.in from any third party due to breach of contract.

LIMITATION OF LIABILITY

Whilst we will take all reasonable steps to deliver your messages to recipients as fast as possible, we cannot commit to, or guarantee, a specific delivery time. Such times depend on various network and system-related factors among the various entities involved in the transportation of your messages across the cellular mobile networks.

Furthermore, delivery reports and the originator are operator dependant features and so it is not possible for us to give 100% guarantees for their availability. We recommend that tests should be conducted beforehand when these features are considered to be of high importance.

You acknowledge that as we send and receive text-messages via major telecommunications companies and Mobile Network Operators, our influence over the transmission of your messages is within the technical constraints imposed upon us.

Our responsibility is therefore to ensure that the text-messages you send through the service are processed correctly and delivered to the assigned entity. We are not responsible for the final delivery of the message, as this is out of our control and is the responsibility of the Mobile Network Operator.

SMS that cannot be delivered within the life span allocated to them, either by us or a Mobile Network Operator will be discarded by the Mobile Network Operator, without any notice. We are not liable for any loss incurred by the failure of a message to be delivered and you acknowledge that damages for financial or other loss resulting from delivery failure cannot be claimed from Team magicSMS.in. Furthermore, you agree that message contents are deemed to have zero value.

You also acknowledge that text-messages are transmitted unencrypted and that eavesdropping of mobile phone communications, including SMS delivery, by third parties is possible. We also recommend that you ensure sensitive and valuable information is communicated by a number of communication methods.

Furthermore, use of the service and the Internet is at its own risk and that the service is provided 'as is' and 'as available', without any warranties or conditions whatsoever, expressed or implied. We will use all commercially reasonable efforts to make access to the service available through the required access protocols, but make no warranty or guarantee that you will be able to access the service at any particular time or any particular location. Without limiting the generality of the terms set forth, we and our affiliates, agents, content providers, service providers, and licensees

Hereby disclaim all express and implied warranties as to the accuracy, completeness, non-infringement, merchantability or fitness for particular purpose of the service generally, and any content or services contained therein, as well as all express and implied warranties that the operation of the service generally and any content or services contained therein will be uninterrupted or error-free.

Shall in no event be liable for any inaccuracy, error or omission in, or loss, injury or damage caused in whole or in part by failures, delays or interruptions of the service generally, and any aspect ancillary thereto; you agree to indemnify us for any third party claims arising from such failures, delays or interruptions in connection with regard to the use of the service.

Notwithstanding anything to the contrary contained herein, the provisions outlined above are for the benefit of Team magicSMS.in and its affiliates, agents, content providers and service providers and each shall have the right to assert and enforce such provisions directly on its own behalf.

MODIFICATION OF TERMS

We frequently update, modify and otherwise continually seek to improve the service and such changes often dictate that we simultaneously modify the terms and conditions of use. As such, we have the right to modify the terms of this agreement and to change or discontinue any aspect or feature of our service, in either case, as it deems reasonably necessary. If you do not agree with any such changes, your use of the service may be cancelled in accordance with the procedures for cancellation set forth in this agreement. You acknowledge your responsibility to review this agreement from time to time and to be aware of any such changes and, should you request, we will be happy to keep you informed if/when such changes take place.

Furthermore, you accept that should there be a contradiction between other specific terms & conditions and these general terms & conditions, the other specific terms & conditions shall apply.

TERMINATION

If at any time you breach the terms & conditions of the service, we may elect to suspend, terminate and/or cancel this agreement and/or recover any damages from you arising from the event(s) giving rise to the suspension, termination or cancellation. We reserve the right to suspend your service at any stage for any reason we may deem necessary to continue to provide any of our services in a way that may be hindered by your status as being our client, your financial status or the content of the messages originating from you.

Upon any such termination, cancellation and/or suspension, you are still responsible for any obligations then accrued. Payment and other obligations under this agreement are not suspended, stayed, or otherwise affected by a suspension of access to / or use of the service (in whole or in part) where said suspension arises from your failure to comply with, or violation of, the terms of this agreement or of any law or legal obligation. Upon termination and/or cancellation, for any reason, you agree to immediately cease using the service and we shall have no obligation to you after any termination or cancellation of this agreement.

You are also free to terminate or cancel this agreement at any time, and for any reason. For such a termination or cancellation to be effective however, you must inform us in writing through email, you will still be under the responsibilities of this agreement for the duration that you used the service and you will cease to have access to the use of any credits that may exist in your account.

Affiliate Program Policy
